1. Introduction
Welcome to Sell Sand! We are a leading multi-vendor marketplace based in Bahrain, dedicated
to providing a platform for sellers to offer and for buyers to find various goods and services. By
accessing or using the Sell Sand platform, you agree to comply with and be bound by these
Terms and Conditions. If you do not agree with any part of these terms, you are prohibited from
using our services.
2. Definitions
"Platform" refers to the Sell Sand website, mobile applications, and other related services.
"User," "You," and "Your" refer to anyone who accesses or uses our Platform, including buyers,
sellers, and visitors.
"Seller" refers to any User who lists a product or service for sale on the Platform.
"Buyer" refers to any User who purchases a product or service on the Platform.
3. User Accounts
3.1 Account Creation
To use certain features of the Platform, you must register for an account. When creating your
account, you agree to:
Provide accurate, complete, and up-to-date information.
Maintain the security of your account, including your password.
Accept all risks of unauthorized access to your account and the information you provide to us.
3.2 Account Termination
Sell Sand reserves the right to suspend or terminate your account and refuse any current or
future use of the Platform if you provide any information that is untrue, inaccurate, not current,
or incomplete, or if Sell Sand suspects such.
4. Use of the Platform
4.1 License to Use
Sell Sand grants you a limited, non-exclusive, non-transferable, and revocable license to access
and use the Platform for your personal and commercial use, subject to the terms of these Terms
and Conditions.
4.2 Prohibited Activities
You are prohibited from using the Platform to:
Conduct any unlawful activities.
Violate any international, federal, provincial, or state regulations, rules, laws, or local
ordinances.
Infringe upon or violate our intellectual property rights or the intellectual property rights of others.
Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on
gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
Submit false or misleading information.
Upload or transmit viruses or any other type of malicious code.
5. Content
5.1 Content Ownership
You retain all your ownership rights to the content you submit, post, or display on or through the
Platform. By submitting content, you grant Sell Sand a worldwide, non-exclusive, royalty-free,
sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works
of, display, and perform the content in connection with the Platform's service.
5.2 User Conduct
You agree not to post, upload, publish, submit or transmit any content that:
Is fraudulent, false, misleading, or deceptive.
Infringes, misappropriates, or violates a third party’s patent, copyright, trademark, trade secret,
moral rights, or other intellectual property rights, or rights of publicity or privacy.
Violates, or encourages any conduct that would violate, any applicable law or regulation or
would give rise to civil liability.
Is defamatory, obscene, pornographic, vulgar, or offensive.
6. Transactions Between Buyers and Sellers
6.1 Marketplace Role
Sell Sand provides a platform for third-party sellers and buyers to negotiate and complete
transactions. Sell Sand is not involved in the actual transaction between buyers and sellers and
does not transfer legal ownership of items from the seller to the buyer.
6.2 Transaction Terms
The seller is responsible for the sale of the goods, all descriptions, and the fulfillment of any
orders. The buyer is responsible for reading the full item listing, committing to buy, and making
payment according to the agreed terms.
7. Disclaimers, Limitations of Liability, and Indemnity
7.1 Disclaimers
Sell Sand provides the Platform on an "as is" and "as available" basis without any warranties,
representations, or conditions of any kind.
7.2 Limitations of Liability
In no event shall Sell Sand, nor its directors, employees, partners, agents, suppliers, or
affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages,
including without limitation, loss of profits, data, use, goodwill, or other intangible losses,
resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any
conduct or content of any third party on the Platform; (iii) any content obtained from the
Platform; and (iv) unauthorized access, use, or alteration of your transmissions or content,
whether based on warranty, contract, tort (including negligence), or any other legal theory,
whether or not we have been informed of the possibility of such damage, and even if a remedy
set forth herein is found to have failed its essential purpose.
7.3 Indemnity
You agree to defend, indemnify, and hold harmless Sell Sand and its licensee and licensors,
and their employees, contractors, agents, officers, and directors, from and against any and all
claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not
limited to attorney's fees), resulting from or arising out of a) your use and access of the Platform,
by you or any person using your account and password; b) a breach of these Terms, or c)
Content posted on the Platform.
8. Amendments
Sell Sand reserves the right, at its sole discretion, to modify or replace these Terms at any time.
If a revision is material, we will provide at least 30 days' notice prior to any new terms taking
effect. What constitutes a material change will be determined at our sole discretion.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of Bahrain, without
regard to its conflict of law provisions. Our failure to enforce any right or provision of these
Terms will not be considered a waiver of those rights. If any provision of these Terms is held to
be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in
effect.
